Abstract
Vive-se, hoje, num mundo de incertezas. O direito passa a ter de lidar com o incerto e não mais com a ordem e a segurança propostas pelo positivismo. O papel do direito pós-moderno consiste em lidar com os percalços políticos, com as dificuldades sociais e com o caos econômico. Não há uma conotação negativa nestas constatações, trata-se, sim, de um enfoque realista da inconstância do sistema mundial como um todo.
