Abstract
The present article aims to revisit some of the clauses of particular relevance in the context of the unilateral trade measures recently adopted by the new North American administration, as well as to highlight examples of concrete cases in which the parties have
encountered contractual issues related to unilaterally adopted trade measures. The objective is to uncover possible practices and strategic recommendations related to the negotiation, signing, and/or eventual resolution of any contractual situation that has arisen from (or is related to) such context, which is marked by both risks and opportunities.
