Abstract
Aiming at strengthening the settlement program in cartel cases, Cade recently enacted regulations that brought undeniable
advances on the subject, as the increasing of the participation of the superintendent general in the negotiation process and the establishment of fixed discount ranges on the amount of the pecuniary penalties. however, the regulation requires further adjustments towards creating a program that is more effective and transparent. In this work, we present some proposals of
changes in that sense, addressing aspects as the value of the calculation basis of the penalties and the provisions relating to the obligations to confess guilt and cooperate with investigations.
