A defesa da concorrência no setor farmacêutico: litígios e acordos anticoncorrenciais

Abstract
This article examines two types of potentially anti-competitive conducts involving the pharmaceutical industry: abusive judicial and administrative proceedings for the extension of patents on drugs, and agreements between reference drugs manufacturers and generic drugs manufacturers to terminate litigation related to patents. After a brief incursion in international experience relating to these conducts, within the scope of highlighting the harmful effects they produce on market and competition, we describe parameters for the treatment of these conducts in Brazilian law, ínferring alternatives able to protect competition in the harmaceutical sector.
