Abstract

This article analyzes the phenomenon of aggressive unilateralism in international trade, focusing on Section 301 of the United States Trade Act. It examines, in an exploratory manner, the compatibility of this instrument with the multilateral rules of the  World Trade Organization (WTO). The article aims to demonstrate how Section 301, although formally compatible with the WTO under certain conditions, represents a constant challenge to the centrality of the multilateral system, requiring international monitoring and vigilance to prevent abuses and protect the predictability of global trade. Furthermore, it takes a first look at the potential repercussions of Section 301 on trade defense investigations, specifically regarding the possible reflective use of the “particular market situation” (PMS) provision in antidumping investigations.
