Resumo

O presente artigo analisa o fenômeno do unilateralismo agressivo no comércio internacional, com foco na Seção 301 do Trade Act dos Estados Unidos. Examina, de modo exploratório, a compatibilidade desse instrumento com as regras multilaterais da Organização Mundial do Comércio (OMC). O artigo busca demonstrar como a Seção 301, embora formalmente compatível com a OMC sob certas condições, representa um desafio constante à centralidade do sistema multilateral, exigindo monitoramento e vigilância internacional para evitar abusos e proteger a previsibilidade do comércio global. Ademais, lança um primeiro olhar sobre possíveis repercussões da Seção 301 em investigações de defesa comercial, em específico sobre a possível utilização reflexa do instituto da “particular market situation” (PMS) das investigações antidumping.
