Resumo

Iniciativas recentes de harmonização (ou convergência) internacional das políticas de defesa da concorrência, cada vez mais processadas por mecanismos de soft law, têm grande variação em formato e impacto (CASTRO, 2017b), destacando-se dois eixos. O primeiro eixo busca a normalização de um consenso técnico acerca das finalidades da política concorrencial: parte das contribuições neste eixo postula que a teoria antitruste deve restringir-se ao quadro conceitual da teoria neoclássica do bem-estar, apurando-se a desejabilidade de práticas econômicas em função de seu potencial de redução do bem-estar do consumidor (definido em função da eficiência alocativa em determinado mercado relevante) (GERBER, 2014, p. 7).
