Economia comportamental e a “cegueira” de autoridades antitruste a estratégias atípicas de abuso

Resumo
Empresas buscam constantemente formas inovadoras para vender mais, melhorar a fidelização de seus clientes e, assim, aumentar ou manter suas participações de mercado. Empresas dominantes são criativas ao tentar abusar de suas posições com estratégias originais e não ser descobertas pelas autoridades concorrenciais. Adotando fundamentos da Economia Comportamental, abordo racionalidade limitada de autoridades concorrenciais frente a estratégias atípicas de abuso de posição dominante. Meu argumento é que autoridades concorrenciais tendem a não perceber novos tipos de práticas de abuso de posição dominante (i) porque vinculam-se a exemplos de práticas listados nas legislações concorrenciais, o que chamo de quase tipos, e (ii) porque também possuem sua própria racionalidade limitada.
