Investimento e disputa uma análise empírica dos procedimentos arbitrais do cirdi de 2014-2024

Abstract
This article provides an empirical analysis of the arbitration proceedings of the International Center for Settlement of Investment Disputes (ICSID) over the last decade (2014-2024). CIRDI was created in 1965 to mediate disputes between investors and States. However, decades after its establishment, the legitimacy and relevance of CIRDI has been questioned, including Bolivia, Venezuela, Ecuador and Honduras denouncing the Convention that established it and renouncing its jurisdiction. In addition, the academic debate has directed a series of criticisms at the CIRDI, mainly regarding its impartiality and its favoring of investors over states. Considering this context of criticism of CIRDI and denunciations of the Washington Convention, this paper seeks, based on empirical analysis, to identify trends in investment arbitration, including (i) the profile of the States most sued under CIRDI; (ii) the main characteristics of investment disputes and (iii) the main characteristics of arbitral awards. To this end, all cases opened and judged within CIRDI between January 2014 and May 2024 were analyzed, resulting in a sample of 198 proceedings.
